Terms of Service

1. Acceptance of terms

By accessing or using ListNiq (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. “ListNiq”, “we”, “us”, and “our” refer to the operators of listniq.com.

2. Description of service

ListNiq provides AI-powered tools to audit, analyse, and rewrite Etsy listings. Features include:

  • Listing Audit:AI health score and plain-English issue breakdown per listing (all plans).
  • Profit Calculator:Calculate real take-home profit after Etsy fees and costs (all plans, free).
  • AI Rewrite: AI-generated title, tags, and description rewrites. Up to 20/month on Seller, up to 300/month on Agency.
  • A/B Title Variants:3 AI-generated title alternatives per listing (Seller + Agency).
  • Priority Fix Queue:Listings ranked by fix impact to maximise your time (Seller + Agency).
  • CSV Export:Export all listing data and audit results (Seller + Agency).
  • New Listing Wizard:Full AI-generated listing from a short description (Agency plan).
  • Review Responder:AI-drafted professional replies to customer reviews (Agency plan).
  • Social Captions:Platform-ready captions for Instagram, Pinterest, and TikTok (Agency plan).
  • Seasonal Tag Alerts:Monthly seasonal tag opportunities for your categories (Agency plan).
  • Customer Persona Builder:AI-generated ideal buyer profile from your listings (Agency plan).
  • Bulk Audit:Audit all listings in one click, up to 50 per run (Agency plan).
  • Market Research:Search public Etsy shop or keyword data for competitive insights (Agency plan).
  • Shop Health Graph:Track your shop health score trend over time (Agency plan).

The Service connects to your Etsy shop via Etsy's OAuth 2.0 API. ListNiq uses AI models (Claude by Anthropic) internally to generate suggestions and rewrites. Results are advisory: we do not guarantee any specific outcome in views, traffic, or sales.

3. Accounts

  • You must be at least 16 years old to create an account.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information and keep your login credentials secure.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free plan and paid subscriptions

  • Free plan: 3 listing audits per calendar month (max 3/day), health score, and first issue per listing. Audit counts reset on the 1st of each month.
  • Seller plan ($15/mo or $150/yr): 200 audits per calendar month (max 50/day), all issues and fixes, AI rewrites (20/month), A/B title variants, push to Etsy, audit history, CSV export, and priority fix queue.
  • Agency plan ($39/mo or $390/yr): 1,000 audits per calendar month (max 200/day), everything in Seller plus AI rewrites (300/month), New Listing Wizard, Review Responder, Social Captions, Seasonal Tag Alerts, Customer Persona Builder, Bulk Audit, Market Research, shop health graph, up to 3 shops, and auto-sync every 4 hours.
  • Annual plans are billed as a single upfront payment and include 2 months free (10 months charged for 12 months of access): Seller $150/yr, Agency $390/yr. Annual plans auto-renew unless cancelled before the renewal date.
  • Unused audit allowances do not roll over to the following month.
  • In addition to the monthly quota, a daily limit applies (as shown above) to ensure fair access for all users and protect service availability. The daily limit resets on a rolling 24-hour basis.
  • Prices are in USD and may be subject to applicable taxes depending on your location.
  • Subscriptions auto-renew. You can cancel at any time from your Settings page and retain access until the end of your current billing period.
  • We do not offer refunds for partial billing periods, except where required by law.

4a. Fair use and abuse prevention

ListNiq uses automated systems to detect and prevent abusive usage patterns, including but not limited to:

  • Automated or scripted requests that exceed normal human interaction speeds.
  • Attempts to circumvent rate limits, quotas, or access controls.
  • Use of the Service to train, fine-tune, or benchmark AI models.
  • Systematic harvesting or scraping of AI-generated output.

We reserve the right to throttle, suspend, or terminate access for accounts that engage in abusive usage, with or without prior notice, at our sole discretion. Rate limits and daily caps apply globally per account and are not cumulative across multiple accounts.

5. Etsy connection

By connecting your Etsy shop, you authorise ListNiq to read your shop and listing data and, if you choose, to update listings via the Etsy API on your behalf.

  • You can disconnect your Etsy shop at any time from your Settings page.
  • You are responsible for ensuring your use of the Etsy API through ListNiq complies with Etsy's API Terms of Use.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal use.
  • Resell or sublicense access to the Service to third parties.
  • Misuse the Etsy API in ways that violate Etsy's terms.
  • Submit content through the Service that is fraudulent, defamatory, or illegal.

7. AI-generated content

Audit results and rewrites are generated by AI. They are provided as suggestions only. You are solely responsible for reviewing any AI-generated content before publishing it to Etsy. We do not warrant that AI output is accurate, complete, or free from errors. We are not liable for any consequence arising from publishing AI-generated content.

8. Intellectual property

You retain ownership of your Etsy listing content. By using the Service, you grant us a limited licence to process your listing data solely to provide the Service. We retain all rights in the ListNiq software, brand, and proprietary methods.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY RECOMMENDATIONS WILL INCREASE YOUR ETSY SALES.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTNIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or at our discretion with reasonable notice. Upon termination, your data will be deleted per our Privacy Policy.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Delaware.
